Agreement between User and https://unleashedmedical.com, including all associated landing pages, URLs owned/operated by Unleashed Medical directors and all social media and advertising platforms used by Unleashed Medical or it’s affiliates.

Welcome to https://unleashedmedical.com.

The https://unleashedmedical.com website (the "Site") is comprised of various web pages operated by Med Grade Fit, PLLC, DBA "Unleashed Medical" ("Unleashed"). https://unleashedmedical.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of https://unleashedmedical.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

https://unleashedmedical.com is a self-pay online telemedicine service that, when clinically appropriate, lets individuals currently located in Florida, United States, receive care from a Florida State licensed Physician Associate. If the healthcare provider evaluates you upon your request to use our Services appropriate, they may write you a prescription and send it to a US-licensed mail-order pharmacy affiliate.

We (Unleashed Medical) may diagnose certain medical conditions, order and interpret labs, and under certain circumstances, may prescribe medication if there is reason the provider believes the patient/client will benefit from it. This includes prescribing some medications "off-label" and medication that is not approved by the FDA. The provider is not obligated to prescribe or refill any medication and may require certain follow-ups and lab work from the patient in order to prescribe or refill medication. We have the right to cancel your membership and payments at any given time.

This is not a primary care service
Any opinions, recommendations, or information given on this page, our social media, or by an Unleashed Medical Provider is not meant to take the place of any other provider.
There are limitations to telemedicine services
All clients/patients should have a Primary Care Provider who they see regularly for in-person comprehensive physical exams
You are using this service at your own risk and accept risks associated with treatment.
By using this service, you confirm that you are in stable health condidtion
You are paying a monthly (or other agreed upon duration of time) subscription to be a patient and to be under the care of Samuel Ranney, PA-C. This includes unlimited Telehealth consultations. You will be charged monthly regardless if you use a follow-up or not and regardless if you receive medication/refills that month.
You may cancel at anytime. However, if you receive medication to last more than a month, it will be your responsibility to pay the duration of the prescribed treatment.

If labs are required for treatment, the lab fee will be the responsibility of the patient unless stated otherwise. If after reviewing labs, the provider finds the patient to be ineligible for treatment, the lab fee will not be refunded; however, there will be no charge for treatment.

If you disagree with one or more of these terms or find them unacceptable in any way, please do not use the Services. You understand that by checking the "I Agree" for these Terms and/or any other forms presented to you on the Services you are indicating your agreement and such action constitutes a legal signature.

Changes to Terms of Use
We have the right to change or add to the terms of this Agreement at any time by posting the amended Terms on Unleashed Medical websites and mobile applications. Any use of the Services after our publication of any such changes shall constitute your acceptance of the Terms as modified.

Emergencies
Unleashed Medical SERVICES ARE NOT AN EMERGENCY-RESPONSE OR EMERGENCY-MONITORING SERVICE AND ANY PERSON WHO IS AWARE OF AN EMERGENCY SITUATION OR BELIEVES THAT A PERSON MAY BE AT RISK OF INJURY OR DEATH OR WHO MAY HARM THEMSELVES OR ANOTHER PERSON SHOULD DIAL "911" OR AN APPROPRIATE EMERGENCY RESPONDER. UNLEASHED MEDICAL IS UNDER NO OBLIGATION TO MONITOR OR RESPOND TO COMMUNICATIONS MADE TO THE SERVICES.

Age Limitations
The Services are intended and only suitable for individuals 18 years of age and above. Some of the content on the Services may not be appropriate for children. Children under the age of 18 are not permitted to use the Services. Unleashed Medical hereby disclaims all liability for use by individuals under the age of 18.

Materials on Services are Not Professional Advice
Except as otherwise described in this section, materials available on the Services and on any Social Media platform operated by Unleashed Medical, including all data, information, text, graphics, links, and other material made available to you on the Services, are provided as a convenience to our Service visitors. The information provided on the Services is for general informational and educational purposes only. Other than the personalized content sent to you by a healthcare provider in a message within the Services or the personalized advice a healthcare provider gives you during a video visit, you should not consider content on the Services to be the provision or practice of medical or professional health care advice or services. The materials provided on our Services are not intended to serve as medical or other professional advice and is not to be used for diagnosis or treatment of any condition or symptom.

You should consult your physician or other qualified healthcare provider regarding any specific questions you may have. You should never disregard professional advice or delay in seeking treatment based on the information contained on the Services or other sites linked to or from it.

Appropriate Use
You may only use the Services from a device located in Florida, U.S. and may only obtain care if you are currently located in Florida where we provide health care services. We make no representations regarding the appropriateness or availability of the Services outside of FL.

Transactions
If you wish to use Unleashed Medical’s services as described or linked to on the Services (each such purchase, a "Transaction"), Unleashed Medical or its affiliates, may request certain information from you that is applicable to your Transaction, including, without limitation, credit card and other payment and shipping information. By providing Unleashed Medical your information, you expressly grant Unleashed Medicalthe right to provide such information to third parties for purposes of facilitating the completion of Transactions initiated by you or on your behalf.

Transactions include, but are not limited to, Unleashed Medical placing an authorization of charge or "Hold" of funds or other monies with your bank or financial institution until your Service request is evaluated by our Medical Team. This authorization is temporary and will only be finalized as a charge after Unleashed Medical evaluates your Service request. You may also be charged for prescription medications or for services rendered under any subscriptions as part of your Service request and use of Unleashed MedicalServices. Some of Unleashed Medical’s products and services require that you purchase the product and/or service on an automatically renewing subscription or refill basis. If you elect for an automatically renewing subscription or refill, your payment will be automatically charged on a regular interval basis (the frequency as described in the service details) until you cancel. You may cancel your subscription or automatic refill at any time. To cancel, you must request the cancellation at least 48 hours before the renewal or refill processing date by emailing admin@unleashedmedical.com or calling(352) 354-2391. You understand and agree that Unleashed Medical’s responsibility for any purchased physical product ends once we’ve delivered the product to the common carrier. YOU FURTHER REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S) OR OTHER PAYMENT MECHANISM USED IN CONNECTION WITH ANY TRANSACTION.

Descriptions or images of, or references to, products or services on the Services do not imply Unleashed Medical’s endorsement of such products or services. We reserve the right, without prior notification, to change such descriptions or references, to limit the order quantity on any product or service and/or to refuse service to you. Verification of information applicable to a purchase may be required prior to Unleashed Medicalacceptance of any order. Price and availability of any product or service are subject to change without notice. Unleashed Medical is not responsible for errors in the prices or descriptions of any product or service. Refunds and exchanges shall be subject to Unleashed Medical and/or any applicable third party’s refund and exchange policies in effect at the time of the applicable Transaction. Promotional codes are not redeemable for cash. Unleashed Medical and its affiliates reserve the right to modify or withdraw promotional offers at any time. Unless otherwise stated, promotions can’t be combined or used with other discounts.

Termination of Services
We may suspend or terminate your access to the Services for any or no reason at any time without notice. Subject to applicable law, we reserve the right to maintain, delete or destroy all communications and materials posted or uploaded to the Services pursuant to its internal record retention and/or content destruction policies. After such termination, we will have no further obligation to provide the Services, except to the extent we are obligated to provide you access to your health records or continue your care due to legal or ethical obligations.

If you are non-compliant (miss required follow-ups and lab orders) your treatment may be discontinued and no refund shall be issued.

Privacy

Your use of https://unleashedmedical.com is subject to Unleashed's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

By using our services you agree to be contacted by Unleashed Medical Providers and staff via text, direct message, email, and phone call unless requested otherwise in writing.

Electronic Communications

Visiting https://unleashedmedical.com or sending emails to Unleashed constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Children Under Thirteen

Unleashed does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use https://unleashedmedical.com only with permission of a parent or guardian.

Cancellation/Refund Policy

You may cancel your subscription at any time and all future payments will be ceased. We do not offer refunds.

The Linked Sites are not under the control of Unleashed and Unleashed is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Certain services made available via https://unleashedmedical.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the https://unleashedmedical.com domain, you hereby acknowledge and consent that Unleashed may share such information and data with any third party with whom Unleashed has a contractual relationship to provide the requested product, service or functionality on behalf of https://unleashedmedical.com users and customers.

No Unlawful or Prohibited Use/Intellectual Property

As a condition of your use of the Site, you warrant to Unleashed that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Unleashed content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Unleashed and the copyright owner. International Users

The Service is controlled, operated and administered by Unleashed from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Unleashed Content accessed through https://unleashedmedical.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless Unleashed, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Unleashed reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Unleashed in asserting any available defenses.

Limitation of Liability and Damages
THE USER’S SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICES IS TO STOP USING THE SERVICES. YOU AGREE THAT UNDER NO CIRCUMSTANCE SHALL ANY OF UNLEASHED MEDICAL PARTIES, OFFICERS, EMPLOYEES, DIRECTORS, PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DAMAGE RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICES OR THE MATERIALS OR DATA ON THE SERVICES. THIS PROTECTION COVERS CLAIMS BASED ON WARRANTY, STATUTE, CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, AND ANY OTHER LEGAL THEORY. THIS PROTECTION COVERS ALL LOSSES AND CLAIMS OF ANY TYPE, INCLUDING, WITHOUT LIMITATION, DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, RELIANCE, CONSEQUENTIAL, EXEMPLARY, AND PUNITIVE DAMAGES, PERSONAL INJURY/WRONGFUL DEATH, LOST PROFITS, GOODWILL, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION. TO THE EXTENT THAT WE MAY NOT, AS A MATTER OF APPLICABLE LAW, DISCLAIM ANY IMPLIED WARRANTY OR LIMIT ITS LIABILITIES, THE SCOPE AND DURATION OF SUCH WARRANTY AND THE EXTENT OF OUR LIABILITY WILL BE THE MINIMUM PERMITTED UNDER SUCH APPLICABLE LAW.

Disputes
If a dispute of any kind arises, we want to understand and address your concerns quickly and to your satisfaction. If we cannot resolve your concerns, we agree to an informal and inexpensive dispute resolution process requiring individual arbitration. "Disputes" between you and Unleashed Medical, including Unleashed Medical Parties, are defined for the purposes of these Terms to include any claim, controversy, or dispute (whether involving contract, tort, equitable, statutory, or any other legal theory) between you and Unleashed Medical, including, but not limited to, any claims relating in any way to these Terms (including its breach, termination, or interpretation), any other aspect of our relationship, Unleashed Medical advertising, and any use of Unleashed Medical services.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Unleashed agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. MED GRADE FIT, PLLC, DBA &QUOT;UNLEASHED MEDICAL&QUOT; AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

MED GRADE FIT, PLLC, DBA UNLEASHED MEDICAL AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. MED GRADE FIT, PLLC, DBA &QUOT;UNLEASHED MEDICAL&QUOT; AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MED GRADE FIT, PLLC, DBA UNLEASHED MEDICAL AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, ANY PRESCRIBED MEDICATION, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF MED GRADE FIT, PLLC, DBA &QUOT;UNLEASHED MEDICAL&QUOT; OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/Access Restriction

Unleashed reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Florida and you hereby consent to the exclusive jurisdiction and venue of courts in Florida in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Unleashed as a result of this agreement or use of the Site. Unleashed's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Unleashed's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Unleashed with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Unleashed with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Unleashed with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms

Unleashed reserves the right, in its sole discretion, to change the Terms under which https://unleashedmedical.com is offered. The most current version of the Terms will supersede all previous versions. Unleashed encourages you to periodically review the Terms to stay informed of our updates.
